1. Information We Collect
We collect information you provide directly (name, email, agency name, billing information), information generated through use of our platform (attendance records, billing data, communication logs), and technical information (IP address, browser type, device information) for security and analytics purposes.
2. How We Use Your Information
We use your information to provide and improve KiddieTrac services, process payments, send service notifications, comply with legal obligations under PIPEDA and provincial privacy laws, and generate anonymized analytics to improve our platform.
3. Data Storage & Location
All data is stored on servers located in Canada and the United States. We use enterprise-grade encryption (AES-256) at rest and in transit. We do not store data in jurisdictions outside North America.
4. PIPEDA Compliance
KiddieTrac is fully compliant with the Personal Information Protection and Electronic Documents Act (PIPEDA). You have the right to access, correct, and request deletion of your personal information at any time by contacting us through our contact form.
5. Children's Privacy
We take the privacy of children in our care data extremely seriously. Child profiles and activity data are accessible only to authorized parents and approved staff. We never share children's data with third parties for marketing purposes.
6. Data Retention
We retain your data for the duration of your subscription plus 2 years, after which it is securely deleted. You may request deletion at any time. Backups are purged within 90 days of deletion requests.
7. Third-Party Services
We use carefully vetted third-party services including Stripe (payment processing), SendGrid (email), AWS Canada (infrastructure), and Google Analytics (anonymized usage). All third parties are contractually bound to our privacy standards.

Terms of Use

These Terms of Use ("Terms") govern your access to and use of the KiddieTrac website, applications, and services (collectively, the "Service") operated by KiddieTrac LLC ("KiddieTrac", "we", "us"). By creating an account, subscribing to updates, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By accessing or using the Service you confirm that you are at least the age of majority in your province or territory and have the authority to enter into these Terms on behalf of yourself or the organization you represent.
2. The Service
KiddieTrac provides childcare-management software including billing, attendance, CWELCC and subsidy tracking, parent communication, and related tools. We may add, change, or remove features over time to improve the Service.
3. Accounts & Eligibility
You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. You must provide accurate information and keep it current. We may suspend accounts that violate these Terms or applicable law.
4. Acceptable Use
You agree not to misuse the Service, including by: attempting to gain unauthorized access; uploading malicious code; interfering with the Service's operation; using it to violate any law or the privacy rights of children, families, or staff; or reselling the Service without our written consent. You are responsible for ensuring your use complies with all applicable childcare, privacy, and employment regulations.
5. Fees, Billing & Subscriptions
Paid plans are billed in advance on a recurring basis. Fees are stated at sign-up and may change with at least 30 days' notice. You authorize us and our payment processor (Stripe) to charge your payment method. Except where required by law, fees are non-refundable. You may cancel at any time; your subscription remains active until the end of the current billing period.
6. Your Data & Privacy
You retain ownership of the data you submit to the Service. You grant us a limited licence to host and process it solely to provide and improve the Service. Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. KiddieTrac is committed to PIPEDA and applicable provincial privacy law.
7. Email & Communications
By subscribing or creating an account you consent to receive service and marketing emails from KiddieTrac, consistent with Canada's Anti-Spam Legislation (CASL). Every marketing email includes a one-click unsubscribe link, and you may opt out at any time without affecting essential service notifications.
8. Intellectual Property
The Service, including its software, design, and trademarks, is owned by KiddieTrac and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.
9. Third-Party Services
The Service integrates with third parties such as Stripe (payments), email delivery providers, and cloud infrastructure. Your use of those services may be subject to their own terms. We are not responsible for third-party services we do not control.
10. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranties of any kind to the extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, KiddieTrac's total liability arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Upon termination, your right to use the Service ends; data export and retention are handled per our Privacy Policy.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts located in Ontario have exclusive jurisdiction over any dispute.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated date and, where appropriate, communicated by email. Your continued use after changes take effect constitutes acceptance.
